1. Acceptance of Terms

By downloading, installing, or using LoanIQ MLO ("the app"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.

2. Description of Service

LoanIQ MLO is an iOS application that helps mortgage loan officers (MLOs) track NMLS continuing education (CE) hours for annual license renewal. The app provides:

• Pre-loaded NMLS CE requirements for all 50 states and DC
• Tools to log, categorize, and monitor CE course completions
• Certificate storage and organization
• December 31 renewal deadline reminders
• PDF compliance report generation (Pro feature)

3. No Affiliation with NMLS or Regulators

LoanIQ MLO is an independent application and is not affiliated with, endorsed by, sponsored by, or connected to the Nationwide Multistate Licensing System & Registry (NMLS), the Conference of State Bank Supervisors (CSBS), the Consumer Financial Protection Bureau (CFPB), or any state mortgage licensing regulator.

Use of the terms "NMLS," "SAFE Act," and related regulatory terminology is for descriptive purposes only to explain the app's functionality.

4. Accuracy of CE Requirement Data

LoanIQ MLO includes CE requirement data based on publicly available information from NMLS and state licensing authorities. We make reasonable efforts to keep this data accurate and current; however:

• CE requirements can change at any time
• State-specific requirements may vary beyond what is reflected in the app
• The app may not reflect the most recent regulatory updates

You are solely responsible for verifying your specific CE requirements directly with your state mortgage licensing authority and NMLS before submitting your annual renewal. LoanIQ MLO is a tracking tool, not an authoritative source of regulatory requirements.

5. Subscription Terms (LoanIQ MLO Pro)

LoanIQ MLO offers an optional premium subscription ("LoanIQ MLO Pro") with the following terms:

• Price: $39.99 per year (price shown in local currency at purchase)
• Free trial: 14 days free if offered; no charge until the trial period ends
• Billing: Charged to your Apple ID at purchase confirmation (or after trial)
• Auto-renewal: Subscription automatically renews annually unless cancelled at least 24 hours before the end of the current billing period
• Cancellation: Cancel at any time in iPhone Settings → [Your Name] → Subscriptions; access continues through the end of the paid period
• Restoration: Use "Restore purchases" in the app to restore a subscription on a new device

All subscription management and billing is handled by Apple. We do not have access to your payment information.

6. License to Use

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use LoanIQ MLO on any iPhone you own or control, as permitted by Apple's App Store Terms of Service. This license does not include:

• Modifying, reverse engineering, or decompiling the app
• Using the app for any commercial purpose other than your own license tracking
• Distributing, sublicensing, or transferring the app to any third party

7. User Responsibilities

You are responsible for:

• The accuracy of CE data you enter into the app
• Verifying your CE requirements with official NMLS sources
• Maintaining and backing up your own data
• Complying with all applicable laws and NMLS regulations governing your license
• Keeping your device secure to protect your data

8. Disclaimer of Warranties

LoanIQ MLO is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The app will be error-free or uninterrupted
• The CE requirement data is complete, accurate, or current
• The app will meet your specific compliance needs
• Data stored in the app will not be lost

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of license, regulatory penalties, lost profits, or data loss arising from your use of or inability to use LoanIQ MLO. Our total liability to you for any claim arising from use of the app shall not exceed the amount you paid for the app in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless LoanIQ MLO and its operators from any claims, losses, damages, and expenses (including attorneys' fees) arising from your use of the app, your violation of these Terms, or your violation of any applicable law or regulation.

11. Intellectual Property

All content, design, code, and features of LoanIQ MLO are the property of the app's operators and are protected by applicable intellectual property laws. The NMLS name and related marks are the property of their respective owners and are used here only for descriptive purposes.

12. Privacy

Your use of LoanIQ MLO is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or this website. Continued use of LoanIQ MLO after changes are posted constitutes acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to LoanIQ MLO at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your license to use the app ceases immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction.

16. Apple App Store Terms

Your use of LoanIQ MLO is also subject to Apple's App Store Terms of Service. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall govern with respect to the App Store relationship.
